User Agreement for the Online Service Yantar.ae

In accordance with the current legislation, online trading through an e-commerce platform is considered distance trading. The contractual relations between the buyer and the seller are formalized in the form of a public offer agreement. By clicking on the "PAY" button on the checkout page of the website, it signifies that the buyer, regardless of their status (individual, legal entity, individual entrepreneur), has undertaken to fulfill the terms of the public offer agreement as per the current Ukrainian legislation, which are specified below.

The public offer agreement is public, meaning that, according to Article 633 of the Civil Code of Ukraine, its conditions are the same for all buyers regardless of their status (individual, legal entity, individual entrepreneur). By fully agreeing to this agreement, the buyer accepts the terms and procedures for placing an order, payment for the product, product delivery, responsibility for dishonest orders, and failure to comply with the conditions of this agreement.

The agreement is considered concluded from the moment the "PAY" button is pressed on the order confirmation page, confirming the purchase.

If necessary and at the buyer's discretion, the agreement can be formalized in writing.

Essential Conditions of the Public Offer Agreement

Terms of the Agreement

• 1.1 The terms of the agreement are the definitions present in this agreement and are an integral part of it.
• 1.2 Definitions are interpreted based on their essence and the content of this agreement. The following is a list of these definitions:

Yantar.ua – Trading platform, online store.

Product – The subject of the agreement between the parties, selected by the buyer on the "Yantar.ae" online store and placed in the online store's cart.

Buyer – Any capable individual, legal entity, or individual entrepreneur, according to current Ukrainian legislation, who visited the Yantar.ua website with the intention to purchase a specific product and pay for its receipt.

Seller – Individual Entrepreneur Slobodanyuk Victoria Viktorivna, according to the contract, the owner of the product offered on the website of the online store.

General Provisions

2.1 This public offer (hereinafter referred to as the agreement) defines the features of buying and selling products on the Yantar.ae website.

This offer applies to any product offered for sale on the Yantar.ua website.

Subject of the Public Offer Agreement

3.1 Providing the Buyer with access to all necessary information about the Product (confirming its quality and safety of use) presented within the Yantar.ae project.

Moment of Agreement Conclusion

• 4.1 The text of this agreement is a public offer and applies to all visitors of the Yantar.ae online store who intend, wish, and can purchase products that do not contain components of animal origin.
• 4.2 Acceptance of the offer is the purchase of the product in the manner specified in this agreement, at the prices indicated on the Yantar.ae website, and agreement with the terms of payment and product delivery.
• 4.3 The fact of purchasing the Product constitutes the unconditional acceptance of the conditions of this Agreement.

A Buyer who has used the services of Yantar.ae is considered a person who has entered into contractual relations with the Seller.

Rights and Obligations of the Parties

• 5.1 Yantar.ua undertakes to deliver the product to the Buyer.
• The product must be delivered: in a specific place together with other accessories and documents related to the product, in a certain quantity in the corresponding completeness and in a set, if provided, of proper quality free from claims of third parties. The Seller undertakes to inform the Buyer of the necessary and reliable information: information about the manufacturer, information about the product.
• 5.1.1 From the moment of concluding this Agreement, to fully fulfill all obligations to the Buyer in accordance with the terms discussed both on the Yantar.ae website and in this agreement. Yantar.ua reserves the right not to fulfill obligations in case of force majeure situations.
• 5.1.2 Not to disclose any private information about the Buyer and not to provide access to this information to third parties, except as provided by law or at the Buyer's request.
• 5.2 Yantar.ua has the right:
• 5.2.1 To change the terms of this Agreement, as well as Tariffs (prices) for Goods and services, unilaterally, by posting them on the website at the address: Yantar.ua
• 5.2.2 All changes take effect immediately upon publication.
• 5.3 The Buyer undertakes:
• 5.3.1 Before concluding the Agreement, to familiarize oneself with the content of the Agreement, the terms of the Agreement, and the tariffs (prices) offered by the Seller on the pages of the Yantar.ae website.
• 5.3.2 To provide all necessary data to the Seller, unambiguously identifying them as the Buyer and sufficient for the delivery of the paid Product to the Buyer.

6. DISCLAIMER OF WARRANTIES

• 6.1 The Seller makes every effort to ensure the quality provision of services to the Buyer. Oral advice and information provided to the Buyer cannot be considered as guarantees.
• 6.2 The Parties are released from liability for non-performance or improper performance of obligations under the Agreement during the force majeure. Force majeure includes extraordinary and insurmountable circumstances that hinder the performance of obligations by the parties under this Agreement. These include natural disasters (earthquakes, floods, etc.), circumstances of public life (war, emergencies, major strikes, epidemics, etc.), and prohibitive measures of state authorities. During this time, the parties have no mutual claims, and each party assumes the risk of the consequences of force majeure circumstances.

7. PRODUCT PRICES

• 7.1 Prices for Goods and services on the Yantar.ua website are determined in the respective sections of Yantar.ae.
• 7.2 Prices for Goods and services may change depending on market conditions. The Seller cannot change the price for a specific Buyer if they have already accepted the Seller's conditions and made payment for the goods or services in accordance with this contract.

8. DURATION OF THE OFFER

• 8. This agreement comes into effect from the moment of applying to ONLINE STORE at Yantar.ae and placing an ORDER, and ends upon the full performance of the obligations by the Parties.
• 8.2 The withdrawal of the offer can be made by the Seller at any time, which is not a reason to refuse obligations for already completed sales.

9. PRODUCT DELIVERY

• 9.1 The Buyer receives the Product through delivery from the Yantar.ae online store or receives it in person. The payment and receipt procedure is specified in this offer agreement.
• 9.2 For the delivery of goods various delivery services are used under cooperation agreements.
• 9.3 Shipment of the Buyer's order takes place after receiving 100% payment from the Buyer according to the invoice.
• 9.4 The fact of receiving the product and the absence of claims regarding the quality of the product is confirmed by the Buyer upon receipt of the check. FOP Slobodanyuk V.V. from "Yantar.ae" guarantees the shipment of the product to the Carrier Company in the quantity specified and paid for by the Buyer, in accordance with the specifications of this product and in proper condition and quality.
• 9.5 The cost of delivery is paid by the Buyer to the Carrier Company independently at the time of product delivery. The exact cost of delivery is determined by the Carrier Company and is announced by the company's courier upon delivery of the product to the Buyer. The cost of delivery includes the transport tariff according to the current carrier price list, insurance, and the cost of returning the signed Buyer's receipt. Employees of the online store, at the request of the Buyer, may inform the Buyer of the approximate cost of delivery for informational purposes only.
• 9.6 In case of the Buyer's absence at the delivery address specified by the Buyer in the application or the Buyer's refusal for reasons other than receiving the product upon delivery by the Carrier's courier, the product is returned to the Seller. The payment for the services of the Carrier Company is deducted from the amount paid by the Buyer for the Yantar.ae product.

10. OTHER CONDITIONS

• 10.1 Information about products is presented on the Yantar.ae website.
• 10.2 The Buyer agrees to receive promotional materials about promotions, sales, marketing programs, etc., conducted by TM "Yantar.ae" through communication means such as email, mobile communication, including the contact details specified by the Buyer in their profile on the site.
• 10.3 All disputes and discrepancies arising during the performance of obligations by the parties under this Agreement are resolved through negotiations. In case of impossibility to resolve them, the parties have the right to seek legal protection of their interests.
